Yame User Agreement

Special Notice

1. The Yame User Agreement (hereinafter referred to as "This Agreement") applies to your use of our services (hereinafter referred to as the "Service"), including the Yame live video streaming application and social network. You are one party, and the other party is Yame TECHNOLOGY PTE. LTD. or its affiliates (us or Yame). In this Agreement, you and Yame will be collectively referred to as the "Parties", and individually as a "Party".

2. When using the Service, you must comply with the 【Yame Privacy Policy】, as well as the terms posted on the Service or applicable to the specific Service, and any supplementary terms related to paid services.

3. By using the Service or clicking "Agree" during the registration process, you agree to all terms of This Agreement. We may modify This Agreement at our sole discretion, and you can find the latest version at: Me > Settings > User Agreement. By continuing to use the Service, you agree to be bound by the modified Agreement.

4. You may only use the Service if you are at least 18 years old and there is no age limit according to the laws of your country.

5. You are solely responsible for the security of your Yame account and password, and all activities conducted through your Yame account will be your full responsibility.

6. We do not accept payments or conduct business with individuals or organizations from Cuba, Iran, North Korea, Sudan, Syria, Crimea, Donetsk, and Lugansk. If you are from these areas, you may be prohibited from using the Service.

Service Content

Our mission is to enable users to build community, connect the world, and share great moments. To achieve the goal of becoming an inspiring content platform for billions of people, we provide the following services:

a. User-Generated Content

 Yame allows users to live stream, use features such as chat, notification boards, forum posts, voice interactions, and many other activities. Users can create, share, transmit, and store content (hereinafter referred to as "User Content"). Other features such as music, images, stickers, virtual items, and other tools provided by Yame ("Yame Features") may be attached to User Content.

b. Helping you discover content, products, and services you may be interested in

We display advertisements and sponsored content to help you discover products and services offered by other businesses and organizations.

c. Combating harmful behavior, protecting and supporting the community

We use advanced technology systems to detect harmful behavior and protect the community. If harmful behavior or content is detected, we will take appropriate actions such as providing support, removing content, restricting functionality, disabling accounts, or contacting law enforcement.

d. Global service access

To operate a global service, we need to store and distribute content and data in data centers worldwide, including outside your country of residence. This system may be directly managed by Yame Technology Pte. Ltd. and its affiliates.

Accounts

· To create an account, you need to provide some information such as an account name and password.

· You have the sole responsibility to maintain the security of your account and password, restrict access to your computer, and are responsible for all activities that occur under your account or password. Please ensure that the information you provide to Yame during registration and at other times is true, accurate, up-to-date, and complete.

· We may allow you to register and log in to the Service through certain third-party services. The collection, use, and disclosure of your information by third parties will be subject to the privacy policies of those third-party services. For more information on how Yame collects, uses, and discloses your personal information when you link your Yame account and when you link your account on any such third-party service, please see our Privacy Policy. We reserve the right to disable your account if you fail to comply with these terms or if we determine that activities from your account may cause harm or violate any third-party rights or applicable laws.

· If you wish to stop using the service and delete your account, please contact us at [email protected] for instructions. After account deletion, you cannot reactivate it or restore any content or information you have added.

Privacy

Your privacy is very important to Yame. Please refer to our privacy policy to understand how we collect, use, and disclose your personal information, as well as how you manage your online privacy when using the service.

Use of the Service

Your access and use of the service must comply with these terms and all applicable laws. You agree to comply with the service terms and the Yame community self-governance rules, and will not:

a. Create, upload, transmit, distribute, or store any content that is inaccurate, illegal, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable;

b. Impersonate any person or entity, falsely state or misrepresent affiliation with any person or entity, gain unauthorized access to another user's Yame account, impersonate others, or transmit content through the service, or engage in any similar fraudulent behavior;;

c. Defame, harass, abuse, threaten, or defraud Yame users, or collect or attempt to collect personal information of users or third parties without their consent;

d. Delete, bypass, disable, damage, or interfere with any security-related features of the service related to user content, prevent or restrict the use or copying of any content accessed through the service, or delete any copyright or other proprietary rights notices on the service or user content;

e. Reverse engineer, decompile, disassemble, or attempt to discover the source code of the service or any part thereof, unless expressly permitted by the law of your residence;

f. Modify, adapt, translate, or create derivative works based on the service or any part thereof, unless expressly permitted by applicable law, notwithstanding this limitation;

g. Disrupt the operation of the service or interfere with any user's experience with the service, by any means, including uploading or disseminating viruses, adware, spyware, worms, or other malicious code;

h. Manipulate identifiers to disguise the origin of any user content transmitted through the service;

i. Interfere with or disrupt the service or servers or networks connected to the service, or violate any requirements, procedures, policies, or regulations of networks connected to the service; use the service in any manner that could affect, interfere with, negatively affect, or inhibit other users' enjoyment of the service, or that could damage, disable, overburden, or impair the functioning of the service;

j. Attempt to circumvent any content filtering technology we use, or attempt to access any area of the service or any service that you are not authorized to access;

k. Use the service for any illegal purpose, or violate any local, state, national, or international law or regulation, including but not limited to intellectual property laws and other proprietary rights, data protection, and privacy laws.

· Yame is not responsible for any user content or any loss or damage arising therefrom. Yame is also not responsible for any errors, defamation, slander, omissions, falsehoods, obscenity, pornography, or profanity you may encounter while using the service. Your use of the service is at your own risk. Furthermore, these rules do not create any private right of action for any third party, nor do they create a reasonable expectation that the service will not contain any content prohibited by these rules.

· Yame is not responsible for any statements or representations in user content. Yame does not endorse any content, opinions, recommendations, or advice expressed in user content and expressly disclaims all liability related to user content. To the extent permitted by applicable law, Yame has the right to delete, censor, or modify any user content posted or stored on the service without notice, including content that violates these service terms or applicable laws. You are solely responsible for creating backup copies of any user content you post or store on the service and bear all costs and expenses. Any act that violates the above terms when using the service constitutes a breach of these service terms and may result in (including but not limited to) termination or suspension of your right to use the service.

Virtual Items

· You can only purchase virtual diamonds (diamonds) and virtual gifts (gifts), send gifts to others, receive monetary value gifts, earn virtual points (points), and if you are 18 years or older (or the age of majority in your jurisdiction), you may withdraw points.

· Diamond prices will be displayed at the point of purchase. All fees and payments for diamonds will be processed through the relevant payment mechanism in the currency specified at the point of purchase. Currency conversion fees, foreign transaction fees, and payment channel fees (if any) will depend on your agreement with the applicable payment provider.

· You are responsible for paying for any diamonds you purchase. Upon completion of the purchase transaction, your user account will be credited with diamonds. Diamonds can be used to purchase gifts. Diamonds cannot be exchanged for cash, legal tender, or currency of any country, region, or political entity, or any other form of credit. Diamonds can only be used on Yame as part of our service and cannot be combined with other promotions, coupons, discounts, or special offers unless designated by us.

· Unless otherwise provided in this agreement, all transactions for purchasing diamonds and gifts are final, and we do not refund any diamond or gift purchases. Diamonds and gifts cannot be exchanged for cash or refunded for any reason.

Payment Terms

· We accept major credit cards, certain debit cards, and/or other payment methods we may make available to you through our website from time to time. You will be required to comply with all terms and conditions of the payment method you choose. When you submit an order through the service, you agree to allow us or our designated payment processor to charge the account you have designated for the purchase amount. All payments will be made in USD, unless other currencies are provided through Yame's payment method.

· Our payment processor may require you to provide certain personal data (such as valid government-issued identification, legal name, address, and date of birth) to process payments through their financial institution and comply with international, national, federal, state, and local laws and regulations. They may also contact you directly regarding any payment-related issues.

· If your purchase is declined online due to an issue with your payment method, please ensure all data is accurate and try again. If the online transaction is not accepted, please contact customer support via the email address related to the purchase. For purchases on the service, you can contact [email protected].

Intellectual Property Rights

· All text, data, images, graphics, sounds, and/or video information and other materials in Yame's service are the property of Yame and are protected by copyright, trademark, and/or other intellectual property laws. Nothing in this agreement shall be construed as granting you any intellectual property rights or any license to such materials from Yame.

· By using and/or uploading any content such as live streams or other content to public areas of the Yame website, you grant Yame and its sublicensees a free, perpetual, irrevocable, non-exclusive, fully sublicensable right to use, copy, modify, adapt, publish, translate, edit, process, create derivative works from, distribute, perform, and publicly display such content (in whole or in part) without territorial, time, or consent limitations and/or compensation, or to incorporate such content into works, media, or technology now known or later developed.

Service Termination

· To the maximum extent permitted by law, Yame has the right to terminate your access to the service without prior notice and deny or prevent future access and use of the service if we reasonably believe that: (a) your use of the service violates this agreement or applicable laws; (b) you use the service fraudulently or abusively; or (c) for legitimate technical or business reasons, we are unable to continue providing the service to you. This includes terminating or suspending your access to any purchased products or services. To the maximum extent permitted by law, your sole remedy for any dissatisfaction with: (i) the service, (ii) any terms of these service terms, (iii) any policy or practice of Yame in providing the service, or (iv) any content or information transmitted through the service, shall be to terminate your account and discontinue use of any part of the service.

Disclaimer

· You must assume all risks associated with using the Yame service. Any risks arising from the use of or reliance on the Yame service are your sole responsibility.

· In any event, Yame does not guarantee that the service will meet your requirements or that the service will be uninterrupted. There are no warranties regarding timeliness, security, or accuracy of the service. You acknowledge and agree that the service is provided by Yame on an "as is" basis. Yame makes no representations or warranties, express or implied, regarding the operation and provision of this service. Yame is not responsible for the quality, timeliness, accuracy, or completeness of the service, or any consequences that may arise from your use of the service.

· Yame does not guarantee the accuracy and completeness of any external links provided in the service for your convenience. Yame is not responsible for the content of any linked website or any link contained in a linked website, and Yame is not directly or indirectly responsible for any loss or damage related to your use of the service. Additionally, Yame is not responsible for the content of any website linked to the service that is not under Yame's control.

· Yame is not responsible for any service interruptions or deficiencies caused by force majeure or situations beyond Yame's control. However, Yame will make reasonable efforts to minimize any loss and impact on you in such cases.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles. Any dispute arising from or relating to this agreement, including issues concerning the existence, validity, or termination of this agreement, shall be finally resolved by arbitration in Hong Kong in accordance with the Hong Kong International Arbitration Centre Administered Arbitration Rules in force at the time. These rules are deemed incorporated by reference. The seat of arbitration shall be Hong Kong, and the language of arbitration shall be English.

Information Requests

All requests for information or documents from the Yame service regarding potential, pending, or current lawsuits, investigations, or disputes, or requests for third-party user information, must be made through proper legal channels and sent to Yame TECHNOLOGY PTE. LTD. for appropriate processing.

Amendments to the Agreement《Agreement》

We may update the terms of this agreement from time to time, such as when we add new features to the service, consolidate multiple applications or services operated by us or our affiliates into one comprehensive service or application, or when there are regulatory changes. We will endeavor to notify all users of any material changes to these terms, such as through notices on the Yame platform. However, you should review the agreement periodically to keep track of changes. Your continued access or use of the service after the new terms take effect will be deemed as your acceptance of the new terms. If you do not agree to the new terms, you must stop accessing or using the service.

Other Terms

· This agreement constitutes the entire agreement between the two parties concerning the matters addressed herein, and neither party has any rights beyond those stipulated in this agreement.

· If any provision of this agreement is declared invalid or unenforceable in whole or in part by a competent authority, the remaining provisions of the agreement shall remain in full force and effect.

· The headings in this agreement are for convenience only and do not affect the interpretation of the agreement.
